Terms of Service

By accessing or using SailingMoney, you confirm that you are at least 18 years old, have the legal capacity to enter into these Terms, and agree to comply with all applicable laws and regulations. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

SailingMoney is a fundraising and donor relationship management platform designed for competitive sailing teams and athletic campaigns. The Service includes tools for contact management, donation tracking, newsletter creation, event management, thank-you card sending, and content generation ("Features").

We reserve the right to modify, suspend, or discontinue any Feature at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of Features.

To use the Service, you must register for an account. You agree to provide accurate, current, and complete information and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must notify us immediately at support@sailingmoney.com of any unauthorized use of your account or any other security breach. We are not liable for any loss resulting from someone else using your account without your permission.

You agree to use the Service only for lawful purposes. You may not:

• Upload, transmit, or distribute content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, or otherwise objectionable
• Use the Service to send spam or unsolicited commercial communications in violation of applicable law
• Impersonate any person or entity or falsely represent your affiliation with any person or entity
• Attempt to gain unauthorized access to any portion of the Service or any systems or networks connected to the Service
• Reverse-engineer, decompile, or disassemble any aspect of the Service
• Use the Service to collect or harvest personal data about other users without their consent
• Use the Service for any purpose other than legitimate fundraising and donor relations for your team
• Transmit any viruses, malware, or other harmful code

We reserve the right to terminate or suspend accounts that violate this section without prior notice.

Your Content. You retain ownership of all content you upload, submit, or create using the Service ("Your Content"), including donor data, newsletters, contact lists, and campaign materials. By submitting Your Content to the Service, you grant us a limited, non-exclusive, royalty-free license to host, store, copy, and display Your Content solely to the extent necessary to provide the Service to you.

Our Content. The Service, including its design, text, graphics, interfaces, and code, is protected by intellectual property laws and owned by or licensed to us. Nothing in these Terms grants you any right to use our trademarks, logos, or service marks.

Responsibility for Content. You are solely responsible for Your Content and any consequences of uploading or distributing it. You represent and warrant that you own or have the necessary rights to Your Content and that it does not infringe any third-party intellectual property rights, violate any laws, or breach these Terms.

SailingMoney offers free and paid subscription plans. By selecting a paid plan, you authorize us to charge your payment method on a recurring basis at the price and interval stated at the time of purchase.

All fees are in U.S. dollars and are non-refundable except as expressly set forth herein or required by applicable law. We reserve the right to change our pricing at any time, with advance notice to existing subscribers.

You may cancel your subscription at any time from your account settings. Cancellation will take effect at the end of your current billing period; you will retain access to paid features until that date. Upon cancellation, your account will revert to the free tier (if available) or will be closed, depending on your plan.

We reserve the right to terminate your account for violation of these Terms. Upon termination for cause, access to the Service will cease immediately and no refund will be issued.

Following account closure, we will retain your data for up to 90 days, after which it will be deleted in accordance with our Privacy Policy. You may export your data before closure.

The Service integrates with third-party platforms including Zoom (video recording), Lob (physical mail), and AI content generation services. Your use of these integrations is subject to the respective third-party terms of service and privacy policies. We are not responsible for the practices of these third parties.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED ACCESS. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT DEFECTS WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SAILINGMONEY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction therein.
